Terms and conditions

These terms and conditions govern the booking of boats through www.yachtrentalpalamos.com. Please read them before booking: by confirming your booking you declare that you accept them.

1. Who we are and in what capacity we act

The website is owned by Boatclean SL (NIF B02761278, Paseo Tomas D’Aquino Boada, 24, 2º 4ª, 17240 Llagostera, Girona). Boatclean SL acts as an intermediary, in the name and on behalf of the lessor. The lessor is the company that owns the boat, identified on the boat’s page or in the booking confirmation, and is responsible for providing the rental service, the boat’s documentation, its insurance and the skipper where the service includes one.

2. Price

The price of each boat and what it does or does not include (fuel, skipper, cleaning, mooring, extras) are shown on its page and in the booking confirmation. Unless otherwise stated, prices include VAT.

3. Booking and payment

  • The booking is confirmed upon payment of 50% of the amount in advance.
  • The balance is payable 7 days before departure.
  • If the boat’s page states a different booking percentage, the one on the page applies.

4. Security deposit

The security deposit is paid by the customer to the lessor on the day of boarding, for the amount shown on the boat’s page, and is refunded in full at the end of the day if there is no damage and there are no incidents.

5. Boating licence

From 1 October 2026, a boating licence is compulsory to operate a rental boat, unless it is hired with a skipper. If the boat is rented without a skipper, the customer must present the licence required on the boat’s page when collecting the boat. If they do not present it, they will not be able to set off and the booking will be considered cancelled by the customer.

6. Cancellation by the customer

  • Up to 30 days before departure: free cancellation, with a refund of the amounts paid.
  • Between 30 and 7 days before: 50% of the total amount is retained.
  • Less than 7 days before: 100% of the total amount is retained.

7. Weather and safety

Trips are subject to weather conditions. If the lessor, the skipper or the Harbour Master’s Office (Capitanía Marítima) advises against departure for safety reasons, a new date or a full refund of the amount paid will be offered. The skipper may change the route or return early if conditions require it.

8. Availability and change of boat

If, owing to unforeseen circumstances, the booked boat is not available, another boat with equivalent or superior features will be offered or, if the customer prefers, a full refund of the amount paid within a maximum of 48 hours.

9. Right of withdrawal

As this is a service related to leisure activities for a specific date, the 14-day right of withdrawal does not apply (article 103.l of Real Decreto Legislativo 1/2007). Cancellations are governed by section 6.

10. Customer obligations

The customer undertakes to respect the maximum number of people authorised, the instructions of the skipper or the lessor, the rules of navigation and those of protected areas, and to be liable for any damage caused by negligent use of the boat.

11. Complaints, applicable law and disputes

You can send any complaint to info@yachtrentalpalamos.com. These terms and conditions are governed by Spanish law. If you are a consumer, the courts of your place of residence will have jurisdiction, and you may use the European online dispute resolution platform: ec.europa.eu/consumers/odr.
